Personal data protection in Indonesia entered a new chapter after the Personal Data Protection Law (PDP) was passed by the Indonesian Parliament on Tuesday (20\/9). The question in this new round is whether this law can end the problem of personal data leakage? To what extent can the PDP law protect a person's personal data? What are the things that need to be of concern to the government in implementing the PDP Law in the future?<\/p>\n
Some of these questions are reviewed in more depth through discussion Forum Populi<\/strong> by header \u201cEnactment of the PDP Law: New Chapter Per<\/strong>da protection<\/strong>ta Digital<\/strong>\u201d. The discussion was held on Thursday (22\/9\/2022) at 10.00 \u2013 12.00 WIB by presenting three speakers, namely Yudha Kurniawan (Bakere University Academician), Mustafa Layong (Assistant Public Lawyer LBH Pers), Usep Saepul Ahyar (Senior Researcher, Populi Center ), and guided by Nurul Fatin Afifah (Researcher, Populi Center).<\/p>\n Yudha Kurniawan started the discussion by emphasizing why someone's personal data must be protected. One of them is to avoid intimidation on line<\/em> in the digital space, preventing misuse of personal data by irresponsible parties, avoiding potential defamation, and preventing other attempts to steal personal data. In addition, Yudha stressed the importance of protecting personal data as a guarantee that someone has the right to control their own personal data.<\/p>\n Mustafa Layong gave a note on the possibility of limiting public rights, especially on freedom of press expression, when the PDP Law was implemented. Mustafa believes that the newly passed PDP Law ignores the rights of journalists to seek, obtain and disseminate information. Mustafa considered this to be due to the minimal involvement of the public in the process of deliberating the PDP Law, especially from the press community.<\/p>\n Mustafa also highlighted the differences in sanctions given to the private sector and the public sector when committing violations. In Article 57, the public sector may only be subject to administrative sanctions. Meanwhile, the private sector, in addition to being subject to administrative sanctions, can also be subject to administrative fines of up to two percent of the total annual income, and can even be subject to criminal penalties. Mustafa said that there should not be inequality in the imposition of sanctions between the private sector and the public sector.<\/p>\n Usep Saepul Ahyar gave a note to the personal data protection agency, which according to Article 58 of the PDP Law has the duty of formulating and establishing personal data protection policies. Usep emphasizes that these institutions play an important role in determining the success and compliance of personal data protection. Therefore, Usep emphasizes the independence of the institution. In addition, according to Usep, a personal data protection agency, it is not only tasked with drafting and implementing regulations, but also educating the public how data can be protected as a person.<\/p>\n In general, the three informants agreed that the PDP Law provides fresh air to the public regarding the issue of personal data security. However, it needs to be a joint concern that there are a number of notes that need to be of concern to the government, especially in the implementation of the PDP Law.<\/p>\n
